Terms and Conditions of Use – MBS Wizard

1. Acceptance of Terms

By accessing or using the MBS Wizard website (the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the Service.

2. Nature of the Service

MBS Wizard is a free, experimental tool designed to assist users in identifying potential Medicare Benefits Schedule (MBS) item numbers by using public MBS data and large language model (LLM) APIs. It is not a medical tool, Medicare resource, or clinical decision-making system.

3. Disclaimer – No Medical or Medicare Advice

The information provided by MBS Wizard:

• Is for general informational purposes only;

• Does not constitute clinical, medical, billing, or Medicare advice;

• Must not be relied upon to make decisions regarding patient care, Medicare claims, medical billing, or compliance with applicable laws or regulations.

Use of this Service is at your own risk. Always consult a qualified healthcare professional or official Medicare authority before making any clinical or administrative decisions.

4. Experimental Use Only

MBS Wizard is an experimental tool provided without warranty or guarantee of accuracy, completeness, or fitness for any purpose. Output may be incorrect, outdated, or misleading. The developers make no representation that the tool is suitable for any specific purpose or complies with any regulatory standards.

5. Do Not Upload Patient or Confidential Information

You must not upload, input, or submit:

• Patient names, dates of birth, Medicare numbers, or any other identifiable personal information;

• Health records or medical histories;

• Any data protected under privacy laws including the Privacy Act 1988 (Cth) or the Australian Privacy Principles (APPs).

MBS Wizard is not intended to process or store health information. Any such data submitted in violation of these Terms is done so at your own risk.

6. Data Handling and Logging

Chats and interactions with the Service may be anonymously logged to improve performance and monitor usage. No identifying personal or patient information is stored or retained.

By using the Service, you consent to:

• Anonymous logging of your interactions;

• Limited data processing via third-party APIs (e.g., LLMs) under their own terms of service.

7. Limitation of Liability

To the fullest extent permitted by law, MBS Wizard, its developers, contributors, and affiliates:

• Disclaim all liability for any loss, injury, claim, or damage arising from the use or misuse of the Service;

• Will not be liable for any errors or omissions in the content or functionality of the Service;

• Will not be liable for any decisions made or actions taken in reliance on the output of the Service.

8. No Warranty

The Service is provided “as is” and “as available” with no warranties or guarantees of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement.

9. Modification and Termination

We reserve the right to:

• Modify or discontinue the Service at any time without notice;

• Update these Terms at any time. Continued use of the Service constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you agree to submit to the exclusive jurisdiction of its courts.
